Biographical Notes:

Terry Moritz has more than 40 years of experience litigating a wide variety of complex disputes both in court and in ADR settings, and he has been consistently recognized for over 15 years as one of Illinois’ best business litigators. In 2014, Mr. Moritz founded his own firm, Terry F. Moritz LLC, (www.moritzlaw.com) in order to increase his ability to focus on prompt and efficient resolution of complex commercial disputes.  Mr. Moritz employs the knowledge he has gained as an advocate to resolve disputes more effectively and efficiently through mediation and  arbitration.

Prior to founding his firm, Mr. Moritz has been a principal in several significant firms, most recently Goldberg Kohn Ltd., where he founded and built the firm’s litigation practice and served as chair of the Litigation Group for over 25 years. 

Mr. Moritz also has extensive business experience as the former co-.owner of a manufacturing enterprise, the former CEO of a small railroad, and outside adviser and co-trustee of a significant family investment enterprise.                                                                                      .

Mr. Moritz has worked extensively in the electric utility, construction and financial service industries.  He has significant experience representing corporate trustees in disputes involving complex financial instruments and has also represented numerous individuals in their role as members of private and public company Boards.  Serving as a special assistant attorney general for both Illinois and Minnesota, Mr. Moritz has successfully defended those States in matters where the constitutionality of state taxes were at issue.  He was lead counsel for the State of Illinois in the landmark Goldberg vs. Sweet telecommunication tax decision in the United States Supreme Court.


Mr. Moritz has significant experience in reorganization proceedings having served as lead counsel for the First Mortgage bondholders in the Chicago Rock Island and Pacific Railroad reorganization, and as lead counsel for the trade creditors and special counsel for the Regional Transportation Authority in the Milwaukee Road reorganization.  Mr. Moritz also served as Trustee and Chief Operating Officer of the Iowa Railroad Company during its 3-year reorganization. He has successfully tried complex tax disputes involving the value of a fleet of nuclear generating facilities and represented electric energy companies in disputes concerning power purchase agreements and long-term supply agreements. He  has prosecuted and defended matters concerning professional malpractice.  He has won matters before the United States Supreme Court, throughout the federal appeals system, and in the state courts of Illinois, New York and Colorado.
 
Mr. Moritz uses his  background in his work as a mediator and arbitrator. Mr. Moritz is a Fellow of the Chartered Institute of Arbitrators ("CIArb"), a member of the American Arbitration Association commercial and energy panels  ("AAA"), a member of the American Law Institute ("ALI"), a member of the International Institute for Conflict Prevention & Resolution ("CPR") serving on the CPR Energy, Oil and Gas Committee, and a board member and panelist for the Forum for International Conciliation & Arbitration ("FICA"). Mr. Moritz is a member of the Executive Committee of Resolution Systems Institute, a not for profit organization focused on strengthening justice by enhancing court supported alternative dispute resolution systems. He has served as a panelist in the Willem C. Vis International Commercial Arbitration Moot, and he has arbitrated over 25  commercial disputes from modest matters to multi-million dollar matters.
